Welcome to Martindale Real Estate Media. By booking a session or using our services, you agree to the following Terms of Service. These terms are designed to set clear expectations and protect both you and us.

1. Services We Provide
We offer a range of professional real estate media services, including:
- Photography (interior, exterior, detail)
- Videography (property walkthroughs, promotional reels)
- Aerial photography and video (FAA-compliant)
- Editing and post-production
- Floor plans (2D and/or 3D)
- Audio recording (narration, voiceovers, ambient audio)

Any additional services outside of the agreed scope may be subject to additional fees.

2. Booking & Scheduling
- Sessions should be booked at least 24 hours in advance to allow for proper scheduling and preparation.
- Clients are encouraged to ensure property access and readiness at the scheduled time.
- If a session needs to be rescheduled or canceled with less than 24 hours�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢?? notice, a cancellation fee may apply.

3. Payment
- Payment is expected upon delivery of final media files.
- Final media will typically be released in full resolution once payment is received.
- Low-resolution previews or watermarked samples may be shared prior to payment if needed.
- Invoices not settled within a reasonable timeframe may result in suspension of future services.

4. Turnaround Times
- Photography: delivered within 24 hours.
- Videography: delivered within 48 hours.
- Rush delivery is available for an additional fee, subject to availability.
- All media is delivered digitally.

5. Rights & Usage
- All media remains the copyrighted property of Martindale Real Estate Media.
- Clients receive a limited license to use the media for:
�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢?�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢ Marketing and advertising directly related to the sale or rental of the specific property.
�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢?�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢ Personal and professional self-promotion (e.g., agent/broker websites, social media, �??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢??just listed/sold�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢?�??????????�?????????�????????�???????�??????�?????�????�???�??�?� posts, marketing portfolios).
- Media may be uploaded to MLS listings during the active listing period.
- Media may not be resold, transferred to third parties, or used by other agents, brokerages, or companies without written permission.
- Removal or alteration of copyright notices or metadata is prohibited.

6. Client Responsibilities
- Properties should be photo-ready (clean, staged, accessible).
- Pets should be secured, access codes provided, and safety conditions confirmed.
- Clients are responsible for obtaining any necessary permissions, such as property or model releases.

7. Limitations of Liability
- We are not responsible for delays caused by weather, property readiness, or client-related issues.
- Our liability is limited to the amount paid for the specific service.
- We are not responsible for MLS compliance beyond the metadata we provide.

8. General Terms
- Martindale Real Estate Media operates as an independent contractor.
- This agreement is governed by the laws of the State of Tennessee, with jurisdiction in Knox County.
- We may update these Terms of Service at any time by posting changes on this page. Continued use of our services constitutes acceptance of the updated terms.
